On April 17th of 1982, Queen Elizabeth II put an end to the British parliament power by amending the Canadian legislation and signing a law in Ottawa. Based on this law, Canada is able to determine its own legislation. One of the most important characteristics of this law is the inclusion of the charter of rights and freedom in the Canadian legislative system, according to which, the rights and freedom of Canadians, which are the bases of freedom and democracy, are beyond other laws and are the bases for legislation. In this article, we will try to briefly investigate the events leading to the formation of this law and discuss several issues such as the views of Quebec and other provinces, the effect of the charter on the request for the haven by refugees, and the rights of immigrants, tribal, and racial minorities.
